<Title>Entry Ban on H-1B Employees</Title>

    <div>We are writing with an important update regarding President Trump's proclamation on September 19, 2025, <a href="https://my3.my.umbc.edu/groups/announcements-faculty-staff/posts/152799/52424/a3deeaf35d7e079d275d6e0317567448/web/link?link=https%3A%2F%2Fwww.whitehouse.gov%2Fpresidential-actions%2F2025%2F09%2Frestriction-on-entry-of-certain-nonimmigrant-workers%2F" rel="nofollow external" class="bo">Restriction on Entry of Certain Nonimmigrant Workers</a>. </div>
    <div><br></div>
    <div>The information contained in our update is provided for informational purposes only and should not be construed as legal advice on any subject matter. </div>
    <div><br></div>
    <div><strong>Context </strong></div>
    <div><br></div>
    <div>The H-1B visa program was created in 1990 by President George H.W. Bush to allow U.S. employers to hire highly skilled workers from outside of the United States to fulfill workforce needs in specialty occupations. UMBC employs nearly 90 research scientists, faculty, and staff through the H-1B visa program and the contributions of these highly skilled individuals contribute to the cutting-edge research and world-class education that we are able to provide. </div>
    <div><br></div>
    <div>On September 19, 2025, President Trump issued a <a href="https://my3.my.umbc.edu/groups/announcements-faculty-staff/posts/152799/52424/a3deeaf35d7e079d275d6e0317567448/web/link?link=https%3A%2F%2Fwww.whitehouse.gov%2Fpresidential-actions%2F2025%2F09%2Frestriction-on-entry-of-certain-nonimmigrant-workers%2F" rel="nofollow external" class="bo">proclamation</a>, Restriction on Entry of Certain Nonimmigrant Workers, that requires employers to make payment of a $100,000 government fee per each individual H-1B employee seeking to enter the United States, unless an exception is granted. This proclamation became effective on September 21, 2025, at 12:01 a.m. EST and will last for 12 months, unless extended. </div>
    <div><br></div>
    <div><strong>Key Provisions </strong></div>
    <div><br></div>
    <div>
    <em>Scope</em>: The proclamation applies prospectively to new petitions of H-1B employees who are outside of the United States while the proclamation is in effect unless covered by an approved exception. The proclamation does not apply to any individual who is the beneficiary of petitions filed prior to the effective date of the proclamation, is the beneficiary of currently approved petitions, or is in possession of a validly issued H-1B non-immigrant visa. </div>
    <div><ul><li>The White House released an <a href="https://my3.my.umbc.edu/groups/announcements-faculty-staff/posts/152799/52424/f826ab860ba96fb887dec4bf6008b9a9/web/link?link=https%3A%2F%2Fwww.whitehouse.gov%2Farticles%2F2025%2F09%2Fh-1b-faq%2F" rel="nofollow external" class="bo">FAQ document</a> making the following clarifications: </li></ul></div>
    <div><ol>
    <li>the proclamation does not apply to any previously issued H-1B visas, or any petitions submitted prior to 12:01 a.m. EST on September 21, 2025; </li>
    <li>the proclamation does not change any payments of fees required to be submitted in connection with any H-1B renewals; </li>
    <li>the fee is a one-time fee on submission of a new H-1B petition; and </li>
    <li>the proclamation does not prevent any holder of a current H-1B visa from traveling in and out of the United States. </li>
    </ol></div>
    <div><ul><li>Memoranda were also issued by <a href="https://my3.my.umbc.edu/groups/announcements-faculty-staff/posts/152799/52424/d9cfdf96e381f84a1aceaa1f95a3244f/web/link?link=https%3A%2F%2Fwww.uscis.gov%2Fsites%2Fdefault%2Ffiles%2Fdocument%2Fmemos%2FH1B_Proc_Memo_FINAL.pdf" rel="nofollow external" class="bo">U.S. Citizenship and Immigration Services</a> (USCIS) and <a href="https://my3.my.umbc.edu/groups/announcements-faculty-staff/posts/152799/52424/528ac5b2c9c60595a71caeb40c67c416/web/link?link=https%3A%2F%2Fpbs.twimg.com%2Fmedia%2FG1UdKwAXIAAxwYU%3Fformat%3Djpg%26name%3Dlarge" rel="nofollow external" class="bo">U.S. Customs and Border Protection</a> clarifying the scope of the proclamation. </li></ul></div>
    <div><br></div>
    <div>
    <em>Travel</em>: According to The White House FAQ and agency memoranda, the proclamation does not impact the ability of current H-1B visa holders from traveling to or from the United States. The entry restriction only applies to new H-1B petitions for individuals who are outside of the United States.</div>
    <div><br></div>
    <div>
    <em>Petition Processing</em>: USCIS will restrict decisions on new H-1B petitions lacking evidence that the $100,000 payment was made in advance of filing the petition when the beneficiary is outside of the United States for as long as the proclamation is in effect, unless an exception is granted. </div>
    <div><br></div>
    <div>
    <em>Visas</em>: U.S. embassies and consulates will not approve issuance of H-1B visas without evidence that the $100,000 payment was made by the filing employer. It is also implied that individuals with approved H-1B petitions who have an employment start date beginning prior to October 1, 2026, will be restricted from obtaining B (business/tourism) visas.</div>
    <div><br></div>
    <div>
    <em>Exceptions</em>: The Secretary of Homeland Security is authorized to grant exceptions to this proclamation for specific individuals, all workers for specific employers and all workers in specific industries. At the time of writing this message, the U.S. Department of Homeland Security has not issued guidance on approved exceptions other than those previously mentioned.</div>
    <div><br></div>
    <div>
    <em>Wages</em>: The Secretary of Labor will initiate rulemaking to revise and raise wage levels for H-1B employees. </div>

    <div><strong>Guidance</strong></div>
    <div> </div>
    <div>
    <em>Travel</em>: H-1B employees planning to travel abroad are advised to consult with the Center for Global Engagement and carry a copy of the CBP <a href="https://my3.my.umbc.edu/groups/announcements-faculty-staff/posts/152799/52424/528ac5b2c9c60595a71caeb40c67c416/web/link?link=https%3A%2F%2Fpbs.twimg.com%2Fmedia%2FG1UdKwAXIAAxwYU%3Fformat%3Djpg%26name%3Dlarge" rel="nofollow external" class="bo">memorandum</a> on their person when passing through a U.S. port of entry. </div>
    <div><br></div>
    <div>
    <em>Staffing</em>: Supervisors should be prepared for the possibility that new hires who are currently outside of the United States will be unable to obtain an H-1B visa or enter the United States unless they qualify for an exception from the proclamation or can provide documentation verifying that the $100,000 fee was paid.     <p>How can we make the world a better place? It's a question that Nathaniel Glover '25, chemical engineering, Jacob Lombardo '25, mechanical engineering, and August Phelps '25, mechanical engineering, have spent a lot of time thinking about.     <p>The three promising researchers were each recently recognized and rewarded by the<a href="https://www.nsfgrfp.org/" rel="nofollow external" class="bo"> National Science Foundation's Graduate Research Fellowship Program</a> (GRFP), which provides financial support to U.S. graduate students who have shown the potential to be high-achieving scientists and engineers. </p>
    <p>"The NSF GRFP award is a very prestigious and competitive award," says Deepa Madan, associate professor in the Department of Mechanical Engineering, who has worked with both Glover and Lombardo on research projects in <a href="https://mesh.umbc.edu/" rel="nofollow external" class="bo">her lab</a>. So far this year the program has awarded <a href="https://cen.acs.org/policy/research-funding/NSF-halves-graduate-fellowship-awards/103/web/2025/04" rel="nofollow external" class="bo">1,000 fellowships across the U.S</a>., about half of the typical number, making the process even more competitive. This fall, Glover, Lombardo, and Phelps will all head to Johns Hopkins University in Baltimore to begin their graduate education and research. </p>
    <h5>The thrill of research</h5>
    <p>Glover, Lombardo, and Phelps knew early in their college careers that they wanted to become researchers. The three are part of the <a href="https://meyerhoff.umbc.edu/about/" rel="nofollow external" class="bo">Meyerhoff Scholars Program</a> at UMBC, which is at the forefront of efforts to increase diversity among future leaders in science, technology, engineering, and mathematics by supporting students who intend to pursue a Ph.D. or combined M.D./Ph.D. in these fields. Throughout their time at UMBC, they engaged in a variety of research projects with different faculty mentors. </p>

    <p>"I really enjoy the quest to answer unanswered questions," Glover says, explaining what attracts him to research. Most recently, he worked in Madan's lab on a project to develop rechargeable, safe, and flexible zinc alkaline batteries, which could revolutionize how consumers power devices such as wearable health monitors.</p>
    <p>Lombardo has also worked in Madan's lab, studying materials that can convert wasted heat into electricity, while Phelps recently worked with mechanical engineering assistant professor <a href="https://ankgoel.umbc.edu/" rel="nofollow external" class="bo">Ankit Goel</a> to develop methods for improving control over the flight trajectory of multicopters. Multicopters, which use multiple rotors for lift and maneuvering, are inherently unstable and underactuated, meaning the craft is limited in the ways it can move and must actively stabilize itself at all times. The researchers developed a method to guide the aircraft along a desired trajectory as precisely as possible despite variations in operating conditions and physical properties of the multicopter.</p>
    <p>The problems the students and their mentors study—such as how to power and control machines—transcend any particular application, and the solutions the researchers develop could have profound effects on a variety of technologies. </p>
    <p>For example, in graduate school, Phelps will join a lab that develops control systems for medical robots. There, he will study electrocauterization, a medical procedure that uses heat generated by an electric current to perform tasks such as removing harmful tissue and controlling bleeding during surgery. Phelps said the speed of the process needs to be carefully controlled to avoid excess damage to healthy tissue, and the lab he is joining is working on ways to automate this control. He notes that both his father and girlfriend have undergone medical procedures with long recovery times. Making the process better is personal to him. </p>

    <br><p>Glover and Lombardo agree that what keeps them going, even through late-night problem solving and failed prototypes, is the desire to improve the way things get done. "I love how engineering research takes fundamental science principles and applies it to making a difference in the world," says Lombardo.</p>
    <p>"My real passion is figuring out how to progress as a species," echoes Glover. "Science is one of our most powerful tools for that." </p>
    <h5>A launch pad for big dreams</h5>

    <br><p>These Retrievers say UMBC offered the tools and the mentorship to progress toward their biggest ambitions. </p>
    <p>"So many people took their time to sit with me, to push me forward," says Lombardo. "I had the opportunity to go to scientific conferences, engage in world-class research, and find a community that embraced me."</p>
    <p>Lombardo notes that with support from programs such as the National Institute of Health's Undergraduate Research Training Initiative for Student Enhancement (U-RISE) program and the <a href="https://swicorps.org/" rel="nofollow external" class="bo">Southwest Regional National Science Foundation Innovation Corps</a> (I-Corps) program, he was able to network with researchers outside of his discipline, as well as with industry experts who understand the consumer market. The interactions honed his career goals and reinforced his passion for translating fundamental science principles into practical and impactful engineering, he says. </p>
    <p>Glover, Lombardo and Phelps agree being awarded NSF GRFP fellowships is both a validation of the work they have done so far and an obligation to make a positive difference with research going forward. "It does make me feel that what we do is seen and appreciated," Glover says. "I have this feeling that I will be able to have the impact that I am hoping to have on the world, which is inspiring and humbling."</p>
    <p>Phelps says he is excited to take the next steps: "I'm looking forward to exploring new topics, pushing the boundaries, and creating new things."</p>

<Title>UMBC Students Bring the Cosmos to the Capital at the Astronomy Festival on the National Mall</Title>

    <div class="html-content">This past weekend, UMBC physics students joined NASA scientists, astronomy educators, and thousands of curious stargazers at the <a href="https://www.hofstra.edu/physics-astronomy/astronomy-festival.html" rel="nofollow external" class="bo">Astronomy Festival</a> on the National Mall—an annual celebration of science that transforms America’s front yard into a field of telescopes, demos, and planetary imagination.<br><br>
    
    Representing UMBC were physics undergrads <strong>Shiney Kumar, Sam Wohl, and Sai Matukumalli</strong>, along with graduate student <strong>Dakota Wolf</strong>, who shared hands-on demos and thoughtful explanations with visitors of all ages. <strong>Sam even shared a laugh with Galileo himself</strong> (author’s note: unclear whether he was part of the official programming or just a very committed Renaissance enthusiast roaming the Mall).  <strong>Shiney guided curious minds through the invisible universe with an infrared astronomy demo</strong>, inspired by the James Webb Space Telescope. <strong>Sai sparked conversations by challenging people to estimate the distance to the Moon</strong>, while <strong>Dakota offered an accessible and engaging explanation of the HARP2 instrument aboard the Earth observing PACE mission</strong>.<br><br>
    
    Also present was UMBC physics faculty member <strong>Dr. Daniel Gonzales, designer and builder of the now-legendary LEGO Solar System mode</strong>l, a perennial favorite at public outreach events. Built to scale (as much as LEGO bricks allow), the colorful and tactile model helped visitors grasp the <strong>sheer size of the planets and the vast distances between them</strong>. It drew plenty of questions—especially about how long it took to build Jupiter (answer: <strong>two years</strong>)—and fortunately, none of the inner planets were lost in the dark.  Pluto wasn’t included. It’s used to the exclusion. The IAU is still accepting complaints.<br><br>
    Though the National Mall is arguably one of the <strong>worst places in America for actual stargazing</strong>, it’s one of the <strong>best places to share the wonders of the universe with the public</strong>.  While it was difficult to see the stars through the light pollution, it was easy to see the spark of curiosity in every visitor.  However, we did get lucky: a cloudy morning gave way to clear skies just in time for festival goers to view the <strong>Sun through solar telescopes</strong>, revealing sunspots and solar prominences in exquisite detail.  As luck (and orbital mechanics) would have it, the <strong>Moon was in its new phase and nowhere to be seen</strong>.  On the other hand, <strong>Saturn did make an appearance</strong>, and many visitors got to gaze at its iconic rings, just as Galileo did four centuries ago.<br><br>
    
    We spoke with <strong>hundreds of visitors</strong>: families, tourists, teachers, and students, all drawn in by curiosity, impressive telescopes, and of course LEGO Jupiter.  Thanks to our student team for representing UMBC with such energy, warmth, and excitement. And thanks to everyone who stopped by to ask questions, share stories, or just whisper ‘cool’ for the tenth time in a row.<br><br>
    
    We’ll be back next year—with more LEGO, more enthusiasm (if that's even possible), and (hopefully) fewer clouds.<br><br>
